For the purposes of this Privacy Notice, “you” and “your” means you as the user of the Services, whether you are a customer (including, a guest or property owner), website visitor, a representative of a vendor, service provider, contractor, business partner, or other organization with whom we have or are considering a business relationship, or another individual whose information we have collected pursuant to this Privacy Notice. This Privacy Notice is designed for our Services for individuals in the United States only and are not intended for users located outside the United States.

This Privacy Notice explains the types of information we process about you when you:

We may modify this Privacy Notice from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Notice. If we make material changes to how we use or disclose information we collect, we will use reasonable efforts to notify you (such as emailing you at the last email address you provided us or posting notice of such changes on the Services) and will take additional steps as required by applicable law.

When you use or access the Services, we collect certain categories of information about you from a variety of sources.

Information You Provide to Us

Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

·       Contact Information, such as name, phone number, postal address, date of birth, profile photo, and email.

·       Account information, such as username, password. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do net share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.

·       Payment information, such as bank account, credit or debit card information, billing address, and other related billing information.

·       Identity Information. Where appropriate, we may ask for an image of your government-issued ID document(s), passport, national ID card, tax ID, or driving license (in accordance with applicable laws).

·       Any other information you choose to include in communications with us, for example, when sending a message through the Services or submitting information about you via a form through the Services.

Information We Collect Automatically

We also automatically collect certain information about your interaction with the Services or when you open an email (“Usage Data”). To do this, we may use tracking technologies including cookies, pixels or pixel tags, local storage, such as browser web storage or application data caches, databases, session replay, and server logs (“Tracking Technologies”). Usage Data includes:

·       Device information, such as internet protocol (IP) address, device type, crash reports, system activity, wireless carrier name (when you use a wireless or mobile device), and the date, time, geolocation, and referrer URL of your request.

·       Location information, such as approximate location based on IP address.

·       Other information regarding your interaction with the Services, such as operating system, browser type, log data, date and time stamps, pages you access on the Services, websites you access before and after visiting the Services, length of time spent on the Services, clickstream data, and ad impressions.

Information Collected From Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information that you choose to have shared with us. Such third parties and information includes:

·       Publicly Available Sources. Contact Information that we obtain from publicly available sources, including public records, professional directories, news articles, real estate agent registrations, tax records, property appraisals, entity property holdings, and publicly accessible social media profiles.

·       Security Partners. Contact Information or other information from partners such as marketing partners, and security partners who provide us with information to protect against fraud and abuse of our Services.

·       Analytics Providers. Information such as IP address, device identifiers, crash reports, system activity, and the date, time, geolocation, and referral URLs that we receive from analytics providers such as Google Analytics.

·       Distribution Partners[B1] . Information such as guest name, reservation details, photos, pricing, availability, email, phone number, and any specific requests made by the guest that we receive from distribution partners, including online travel agencies and vacation rental booking platforms such as Airbnb or VRBO and other third-party booking channels through which our properties are marketed or reserved.

·       Advertising Partners. Information such as device identifiers, approximate location, hashed contact info, ad engagement data, inferred interests that we receive from advertising or retargeting partners such as Google Ads, Meta Ads, and Meta Pixel.

·       Social Media Platforms. Information such as interactions with our posts, pages followed, profile information you make available based on your settings that we receive from social media platforms.

·       Property Management Systems. Information such as reservation details, check-in/check-out times, access codes, and property usage data that we collect through property management software and smart home or access control systems.

Any information we receive from outside sources will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. With respect to the categories of information we collect, we use information about you as described below:

·       Services and Purpose Collected. To provide and operate the Services; process transactions; administer accounts; respond to requests; and carry out the activities for which the information was collected.

·       Communication with You. To send service-related and transactional communications, including confirmations, updates, responses to inquiries, and other notices related to your use of the Services.

·       Personalization; Advertising; Analytics. To tailor and personalize your experience on the Services; respond to questions and requests; customize the content we display; provide recommendations; understand usage and improve the Services; and support advertising and retargeting activities, including sharing information with third-party Analytics Providers and Advertising Partners.

We may deidentify information about you such that it cannot reasonably be used to infer information about you or otherwise be linked to you (or we may collect information that has already been deidentified), and we may use such deidentified information for any purpose.  To the extent we possess or process any deidentified information, we will maintain and use such information, we will maintain and use such information in deidentified form and not attempt to re-identify the information, except solely for the purpose of determining whether our deidentification process satisfies legal requirements.

The Services use cookies and other Tracking Technologies to facilitate and enhance your experience on the Services; understand how you access and use the Services (including which pages you visit and how often); analyze usage trends; personalize content; provide advertising and retargeting; and for the other purposes described in this Privacy Notice.

Third parties, including Analytics Providers and Advertising Partners, may also place Tracking Technologies on your device when you use the Services. The information collected by these third party Tracking Technologies is governed by the privacy policies of those third parties.

Do Not Track & Global Privacy Controls

Our website recognizes the Global Privacy Control (GPC) signal which enables you to opt out of certain uses or disclosures of information about you. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms. Information you provide on public or semi-public venues, such as third party social networking platforms, may also be viewable by other users of the Services and/or users of those third party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owner or operators.

The Services may also incorporate features, add-ons, portals, and content including feeds, scripts embedded in the Services’ code, and visible content (e.g., videos), provided by third parties. In some cases, those third parties collect data about how you interact with their content.

Google Maps Features

The Services may also include Google Maps features and content. Google Maps features and content is subject to the then-current versions of Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.

Children under the age of 13 are not permitted to use the Services, and we do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected information about a child under 13 years of age, we will make commercially reasonable efforts to delete such information. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the information below to request that it be deleted.

Despite our reasonable efforts to protect information about you, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

Information you provide to us should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up to date. We retain information about you for as long as it is reasonably necessary for the purposes specified in this Privacy Notice. When determining the length of time to retain information about you, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or product.

In the preceding 12 months, we collected the categories of personal information listed in the table below. For each category, we indicate (i) the business or commercial purposes for which the information was collected, as described in the Uses of Information section above, and (ii) the categories of third parties to whom we disclosed the information for a business purpose, as described in the Disclosure of Information section above.

We only use and disclose sensitive personal information for the purposes permitted under applicable U.S. state privacy laws.

Data Retention

The criteria we use to determine how long to retain personal information about you is described in the section above, Data Security and Retention.

Selling and/or Sharing of Personal Information

We do not have actual knowledge that we “sell” or “share” personal information, or engage in “targeted advertising” (as those terms are defined under the U.S. state privacy laws and used throughout this section), with respect to personal information of residents under 16 years of age.

In the preceding 12 months, we sold / shared and engaged in targeted advertising with the categories of personal information listed below.

Your U.S. Privacy Rights

Depending on where you are located, you may have certain rights regarding your personal information, subject to applicable law and any exceptions. Where available to you, these rights include:

·       Right to Know. The right to request that we disclose to you the personal information we collect, use, or disclose, and information about our data practices. For residents of certain states, this may include a list of third parties (as defined by applicable law) to whom we have disclosed your Personal Information.

·       Right to Delete. Delete personal information about you.

·       Right to Opt-Out of Selling or Sharing / Targeted Advertising. Opt-out of (i) the sale of personal information about you; and/or (ii) the use of personal information about you for targeted advertising purposes. Exercise this right by using the Global Privacy Control as noted in the Do Not Track & Global Privacy Controls section above or via the Cape & Coast Privacy Rights Request .

·       Right to Limit Use of Sensitive Personal Information. Direct us to limit our use and disclosure of your sensitive personal information to certain permitted purposes.

·       Right to Opt-Out of Profiling. Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

·       Right to Non-Discrimination. Be free from discriminatory treatment for exercising any privacy rights.

Additional California Privacy Rights

In addition to those rights set forth in the Your California Privacy Rights section above (as applicable), California law also permits residents to request certain details about how their “personal information” (as defined in California Civil Code Section 1798.83) is shared with third parties for their direct marketing purposes. We may from time to time elect to share certain personal information about you with third parties for those third parties’ direct marketing purposes. Residents may, under certain circumstances, obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year. Verification

To verify certain requests, for example, requests to know, delete, or correct, we may need to collect additional information to verify your identity and the request, such as your email address, phone number, reservation information, property ownership information, or other information reasonably necessary to match you to records maintained by Cape & Coast, before providing a substantive response to the request.

If you have a registered or authorized agent act on your behalf, we may require documentation sufficient to verify the agent’s authority to submit the request and may also require you to verify your identity directly with us, as permitted by applicable law.

Appeal

Depending on your state of residence, if we decline to take action on your request, you may appeal our decision by submitting an appeal through our Privacy Rights Request form or by emailing us at [email protected]. Please identify the request you are appealing to and provide any additional information you believe is relevant. We will respond to your appeal within the time period required by applicable law.
